Terms & Conditions
These terms set out the basis on which Mongkol Law provides pension legal services. We have written them as plainly as we can. If anything is unclear, please reach out before proceeding.
Definitions
Throughout these Terms, the following words carry the meanings set out below:
- "Agreement"
- These Terms & Conditions, together with any engagement letter or service confirmation issued by Mongkol Law.
- "We / Us / Our"
- Mongkol Law, a legal services firm located at 33 Ratchadaphisek Road, Din Daeng, Bangkok 10400, Thailand.
- "Client / You / Your"
- Any individual or organisation that engages, or seeks to engage, Mongkol Law for legal services.
- "Services"
- The pension legal advisory, review, and representation services offered by Mongkol Law, as described on our website and in any service engagement correspondence.
- "Content"
- All text, documents, briefing notes, analysis, and other materials we produce as part of the Services.
- "Website"
- The website operated by Mongkol Law at https://mongkollis.sbs.
Acceptance of Terms
By using our website, submitting an enquiry, or engaging Mongkol Law for any service, you confirm that you have read, understood, and agree to be bound by these Terms.
You must be at least 18 years of age and have the legal capacity to enter a binding agreement under Thai law. If you are acting on behalf of an organisation, you confirm that you are authorised to bind that organisation.
If you do not agree with any part of these Terms, please do not proceed with using our services. We are happy to answer questions before any engagement begins.
Services Described
Mongkol Law provides legal services relating to pension matters in Thailand. Our current service offerings are:
- Pension Rights Briefing (฿4,300) — A written briefing explaining your pension entitlements, recent changes, and available options, prepared in accessible language.
- Decision Review & Response (฿9,500) — Careful review of a pension decision you consider unfair, together with preparation of a formal written response and document support.
- End-to-End Appeal Support (฿17,100) — Full case management for a formal pension appeal, from initial preparation through to representation, with clear cost information at each stage.
Services are available to clients located in Thailand. Availability may vary depending on the circumstances of each matter. We will confirm the scope of services in writing before work begins.
Client Responsibilities
To allow us to assist you effectively, we ask that you:
- Provide accurate and complete information about your situation;
- Supply relevant documents promptly when requested;
- Notify us of any changes that may affect your matter;
- Respond to our correspondence within a reasonable time;
- Use our services only for lawful purposes;
- Treat our staff with courtesy and respect.
We cannot be held responsible for delays or difficulties arising from incomplete, inaccurate, or late information provided by the client.
Prohibited conduct includes:
- Providing false or misleading information;
- Attempting to use our services to support a fraudulent claim;
- Sharing confidential materials prepared by us without our written consent;
- Any conduct that places our firm, staff, or other clients at risk.
Intellectual Property
All content on our website — including text, design, layout, and original documents — is the intellectual property of Mongkol Law and is protected under applicable Thai law.
We grant you a limited, non-exclusive, non-transferable licence to access and use our website for personal, non-commercial purposes. This licence does not permit you to copy, distribute, modify, or republish any part of our website without prior written consent.
Documents and briefing notes prepared specifically for your matter are provided for your personal use in connection with that matter. They may not be reproduced, shared with third parties, or used as legal templates without our prior written agreement.
Fees & Payment
Our service fees are stated in Thai Baht (฿) and are confirmed in writing before any work commences. Current fees are published on our website and are subject to change with reasonable notice.
Payment is due upon receipt of our invoice, unless an alternative arrangement has been agreed in writing. For the End-to-End Appeal Support service, a clear cost outline is provided at each stage before that stage proceeds.
We accept payment by bank transfer to our designated account. Details will be provided in our engagement documentation.
Refunds: If a service cannot proceed due to circumstances on our side, we will refund any fees paid for work not yet undertaken. Once work on a matter has begun, refunds are considered on a case-by-case basis, having regard to the work already completed. We aim to handle all such situations fairly and with candour.
Service Delivery
We will agree the scope and expected timeline of each service with you in writing before work begins. We aim to work steadily and keep you informed at meaningful points.
Timelines may be affected by factors outside our control, including the responsiveness of third parties such as government agencies or pension funds, or the complexity of the matter as it develops. We will notify you of any significant change to an expected timeline as soon as we are aware of it.
Requests to expand or change the scope of a service will be discussed with you and, if agreed, confirmed in a revised engagement note along with any adjustment to fees.
Confidentiality
We treat all information shared with us by clients as confidential. We will not disclose your personal information or case details to any third party without your consent, except where required by law or necessary to provide the service (for example, corresponding with a government agency on your behalf).
Our handling of personal data is governed by Thailand's Personal Data Protection Act (PDPA) B.E. 2562 (2019) and described fully in our Privacy Policy.
Disclaimers
Our services are provided on the basis of our professional knowledge and careful assessment of the information available to us. We cannot and do not commit to any particular outcome in any pension matter.
The information on our website is provided for general guidance only and does not constitute legal advice for any specific situation. You should seek a formal service engagement before relying on any information for your own matter.
Outcomes in pension proceedings depend on many factors, including the decisions of government agencies, tribunals, and courts. We will always give you our honest assessment of your position, but no representation is made regarding the result of any particular matter.
Limitation of Liability
To the extent permitted by Thai law, our total liability to you in connection with any service is limited to the fees paid by you for that specific service.
We are not liable for indirect or consequential losses, including loss of income, loss of opportunity, or losses arising from reliance on third-party decisions, except where such liability cannot be excluded by law.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless Mongkol Law, its personnel, and associates from any claim, liability, or expense arising from your breach of these Terms, your provision of false or misleading information, or your use of our services in a manner not permitted by these Terms.
Termination
By you: You may end the engagement at any time by notifying us in writing. You will be responsible for fees in respect of work already completed at the time of termination.
By us: We may end the engagement with reasonable written notice if it becomes impractical or inappropriate to continue — for example, if accurate information cannot be obtained, if instructions conflict with legal or ethical requirements, or in the event of a breakdown in the working relationship.
Effect: On termination, we will return your documents to you and retain copies only as required by law or professional obligations. Clauses relating to confidentiality, intellectual property, liability, and dispute resolution continue to apply after termination.
Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the Kingdom of Thailand.
If a concern arises from our services, we ask that you first contact us directly so that we can try to resolve the matter in a straightforward and cooperative way. We take all feedback seriously and will respond within a reasonable time.
If a matter cannot be resolved informally, the parties agree to attempt mediation before pursuing court proceedings. Any disputes that proceed to litigation will be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
General Provisions
Entire Agreement: These Terms, together with any written engagement confirmation, constitute the entire agreement between you and Mongkol Law in relation to the services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
Waiver: Our failure to enforce any provision on one occasion does not constitute a waiver of that provision on any future occasion.
Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may engage qualified associates or contractors to assist with services, subject to confidentiality obligations.
Notices: Formal notices should be sent in writing to our registered address or by email to [email protected].
Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or good practice. The updated version will be posted on our website with a revised date.
For active engagements, we will notify you of any material change by email. Your continued use of our services after the effective date of any change constitutes acceptance of the updated Terms.
